Our Privacy Policy is fueled by our commitment to the following Privacy Principles:

  5. We do not display advertising on Zircel. Our mission is to provide you with a tool which is easy to use but powerful likewise, not to sell you products.

About our Privacy Policy

Zircel (“Zircel”, “us”, or “we”) feels strongly about protecting your privacy. We understand how important privacy is to you, and we are committed to creating a safe and secure environment for all online users. This Privacy Policy applies to zircel.com and all integrations of a Zircel application on any other online platform (“Tool”), which are all owned and operated by Zircel. This Privacy Policy describes how Zircel collects and uses the information you provide on our Tool, and describes the choices available to you regarding our use of your personal information and how you can access and update this information.
Our Privacy Policy describes what information we gather from our members and others who visit and use our Tool, how we use that information, and what we do to protect it. By visiting or using our Tool, you consent to the information handling practices described in this Privacy Policy.

1. What information do we collect?

We take the information you provide to us very seriously, and we strive to put you in control of decisions around your information.

If you are a user of the Zircel Tool itself and create and maintain your own applications, you are a so-called customer (“Customer”). If you are using a Zircel application by clicking through its conversational model without creating or maintaining your own applications, you are a so-called enduser (“Enduser”). The first part is dedicated to the Customers, while the second focuses on the Endusers.

A. What kind of information we collect from our Customers

If you create an account on the Zircel website, or communicate with the Zircel team, you may provide to Zircel what is generally called “Personal Information” or “Personal Data,” such as your full name, company name and email address or other information that can be used to identify you. Information which cannot be used to identify you as an individual is “de-identified” or non-personal information.

We collect information, including personal information, in a variety of ways which may vary according to your use of the Tool and your account settings. The categories of personal information we collect may include:

Information you provide to us

Contact, profile and company information.

When you create an account on the Zircel website, or communicate with us, we may collect personal information including your name, company’s name and email address. In addition, we may ask you for personal information at other times, such as when you contact our technical support team, send us an email, complete a user survey, or otherwise communicate with the Zircel team.

This enables us to improve our Tool and to tailor it to our Customer needs.

Location information.

We may collect and use information about your location (such as your country) or infer your approximate location based on your IP address in order to provide you with tailored tips for your region, but we don’t collect the precise geolocation of you or your device. You may be able to change the settings on your computer or mobile device to prevent it from providing us with any location information.

Device information.

We may collect device information during your use of our Tool to be able to correlate device types and versions with problems which may appear. This helps us to identify a possible problem which results in a faster fix. This includes information about your browser and online usage patterns (e.g., Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, pages viewed, links clicked), and information about the device(s) you use to access the Tool (e.g., device type, model and manufacturer, mobile device operating system brand and model, and whether you access the Tool from multiple devices).

B. What kind of information we collect from our Endusers

If you are using our Tool as an Enduser, you may encounter our Tool on zircel.com itself or any other online platform. During your usage of the Tool, you may provide to Zircel what is generally called “Personal Information” or “Personal Data,” such as your full name, birthdate and email address or other information that can be used to identify you. The Personal Data you may need to provide or not depends on the implementation of the Tool by the Customer. Information which cannot be used to identify you as an individual is “de-identified” or non-personal information.

Information you provide to us

Contact information.

When you use our Tool, we may collect personal information including your name, address, birth date and email address. The exact type of information may vary as the implementation of the Tool is not done by Zircel itself, but by our Customers. Possible implementations may be a product offer or a customer survey. Dependent on their need of your information, other information may be requested.

Information about how you access and use the Tool

Information about your use of our Tool.

We may collect usage information about your use of our Tool, such as the clicks you perform and how long you take to perform another click. We may collect analytics data, to allow the Customer to measure traffic and usage trends for his or her Tool created with Zircel and to understand more about the demographics of the Endusers. This enables the Customer to improve his application.

Location information.

We may collect information about your location (such as your country) or infer your approximate location based on your IP address in order to provide the Customer with the opportunity to place tailored tips for your region, but we don’t collect the precise geolocation of you or your device. You may be able to change the settings on your computer or mobile device to prevent it from providing us with any location information.

Device information.

We may collect device information during your use of our Tool to enable us to correlate device types and versions with problems which may appear. This helps us to identify a possible problem which results in a faster fix. Further, the Customer may need device information to analyse his target market and preferences of his Endusers. This includes information about your browser and online usage patterns (e.g., Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, pages viewed, links clicked), and information about the device(s) you use to access the Tool (e.g., mobile device identifier, mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, and whether you access the Tool from multiple devices).

2. How we use the information we collect

To provide and enhance our Tool.

Zircel uses the information you provide or that we collect to operate, maintain, enhance, and provide all the features of our Service.

To understand, improve, and develop our Tool.

Zircel uses all the information that you provide or that we collect from Customers/Endusers to understand and analyze the usage trends and preferences of our Customers/Endusers, to improve the way the Tool works and looks, and to create new features and functionality.

To personalize your experience as a Customer.

We use the information to personalize your experience while using the Tool as a Customer, including on various devices you may use to access the Tool. For instance, Zircel remembers your recent activity so we can recommend the most appropriate content for you on your next visit and provide personalized tips.

To communicate with you as a Customer.

We use your information to communicate with you about your account and respond to inquiries. We may also use your Personal Information to provide you with information about Zircel’s features, services and other offerings that may be of interest to you.

To improve your experience as a Enduser.

Zircel uses all the information that you provide or that we collect from Endusers to help the Customer to understand and analyze the usage trends of his own-created application. This enables the Customer to improve the way his application works and looks, which enhances the Enduser’s experience.

Data collected by Zircel is stored on its servers in Germany, hosted by Amazon Web Services. 3. How we share or transfer data

Zircel takes great care to protect the information you provide us. We do not rent or sell Personal Information that we collect from Customers/Endusers with third parties. Not-shared data is stored by Zircel on its servers in Germany, hosted by Amazon Web Services.

We may process your personal information to our Customers.

Applications created with our Tool by our Customers may request personal information from its Endusers to complete their application’s process. This may be for example a product offer or a customer survey which requests the Enduser’s name or email address. Zircel processes and shares such information to/with the respective Customer to offer services to their Endusers. The personal information may be transferred to the Customer’s servers (location can be found out in the respective Customer’s Privacy Policy). If the data is transferred outside the European Union, we guarantee an appropriate level of protection.

We may share anonymous or aggregated data with others.

We may use data which has been de-identified and/or aggregated for product development, research, analytics and other purposes, including for the purpose of analyzing, improving, or marketing Zircel. In certain occasions, Zircel may share this data with third parties to be used for research only. It won’t be sold. If we disclose information to authorized third parties to conduct research or assist in understanding the usage, viewing, and demographic patterns for certain programs, content, services, promotions, and/or functionality on our Tool, such data will be aggregated and/or anonymized to reasonably avoid identification of a specific individual.

4. How does Zircel protect children’s data

Children under 16 may interact with a conversational model created with Zircel as an Enduser or create an account as a Customer with the legal guardian’s consent only. A legal guardian is a person who has the legal authority and corresponding duty to care for the personal and property interests of a children. By accepting the Privacy Policy, children confirm that they have received their legal guardian’s consent. In this case, the children’s personal data will be processed as outlined in this policy.

5. Marketing and Third Parties

Zircel does not display any third-party advertisements on the Tool and does not use third-party cookies for tracking. It may be possible that we display YouTube video content if a Customer includes such in his created conversational model. While Zircel-created video content does not display video advertisements, third party content may include advertising which we cannot control. Further, YouTube incorporates tracking technologies, which may be present in the YouTube videos embedded on the Tool, which may collect information from your browser when you view the video on the Tool, including device identifiers and/or cookie IDs. This information is collected directly and automatically by YouTube and its partners, and Zircel does not participate in these data transmissions. Zircel does not provide any Personal Information, such as user names, to YouTube.

6. Your choice and options relating to data collection and use

At Zircel, we use Personal Information as needed for the purposes for which it was collected or where you have consented to our use of your Personal Information. We take reasonable steps to ensure that the Personal Information we store and use is accurate, complete, and up-to-date. If you discover that Personal Information or other data pertaining to you is inaccurate, incomplete, or out-of-date, please update your account information or contact us as outlined below.

Zircel may, from time to time, send you email (if you are a Customer) regarding our products and services. Only Zircel (or our vendors operating on our behalf) will send you these emails. These emails are essential as they may also contain valuable information for your further usage of our Tool as a Customer.

7. How to access, update, or delete your personal information. How to withdraw consent.

A. How to access, update or delete your information as a Customer.

We want you to have access to your information as Customer, so that you can help keep it as accurate as possible. If you register and provide Zircel with Personal Information, you may update, correct, or delete your account and information at any time by reviewing your profile information and preferences on your account settings page.

To request deletion of your personal information at any time, please log into your account and select the Tab “Settings” where the “Delete Account” section can be found. Please note that your information will be retained in backup for up to two weeks.

Unless we receive a deletion request, we will retain your information for as long as your account is active or as is reasonably useful for operational purposes. For example, we may retain certain data as necessary to prevent fraud or future abuse, for recordkeeping or other legitimate business purposes, or if required by law. We may not be able to delete data in all instances, such as information retained in technical support logs and other business records. We may also retain information which has been de-identified or aggregated such that it can no longer reasonably identify a particular individual. All retained personal information will remain subject to the terms of this Privacy Policy.

B. How to access, update or delete your information as an Enduser.

We want you to have access to your information as Enduser, so that you can help keep it as accurate as possible. You are able to request an insight, a change or a deletion of your personal information by sending an email to admin@zircel.com.

For example, we may retain certain data as necessary to prevent fraud or future abuse, for recordkeeping or other legitimate business purposes, or if required by law. All retained personal information will remain subject to the terms of this Privacy Policy.

C. How to withdraw consent.

Zircel needs your consent on the Privacy Policy and the Terms Of Service to provide you our services. If you intend to withdraw your consent for whatever reason you have, you need to delete your account as a Customer or request a deletion of your Personal Infornation by email as an Enduser. Without your consent, Zircel’s services cannot be provided.

8. Our approach to Data Security

Data security is important to you, and to us.

To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. For example, we may ask you to provide certain Personal Information to confirm your identity, and we may require that you create and use a password to access certain parts of our Tool. You should create and maintain a strong password to help ensure the security of your account.

We try to ensure that our Tool and information sent to us are safe, but no security measures are perfect.

Zircel uses certain physical, managerial, and technical safeguards designed to preserve the integrity and security of your Personal Information and other information we maintain in connection with our Tool. We cannot, however, ensure or warrant the security of any or all of the information you transmit to Zircel, and you do so at your own risk. Once we receive your transmission of information, Zircel makes commercially reasonable efforts to ensure the security of our systems. When you enter sensitive information, we encrypt the transmission of that information using secure socket layer technology (SSL) or similar technologies. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you of the security incident in accordance with applicable laws and regulations.

9. International Visitors

Our Service is operated and managed on servers located within Germany. If you choose to use our Tool from the United States or other regions of the world with laws governing data collection and use that differ from European Union law, then you acknowledge that Zircel will transfer your personal information to the European Union for the purpose of performing the Tool according to our contract (e.g., our Terms of Service) and for any other purpose for which you provide explicit, informed consent.

11. Links to other sites

The Tool may link to and may be linked by websites operated by other entities or individuals. Some of these websites, such as the Zircel Facebook page, may be co-branded with our name or logo. This Privacy Policy does not apply to, and we cannot always control the activities of, such other third-party websites. You should consult the respective privacy policies of those third-party websites.

12. Changes and updates to this Privacy Policy

Zircel may modify or revise this Privacy Policy from time to time. Zircel will notify users of any changes to our Privacy Policy by posting the revised Privacy Policy with an updated date of revision on our website. If we change this Policy in a material manner, we will do our best to notify you of the changes by posting a notice on our website. Your continued use of the Tool following the effective date of such update constitutes your acceptance of the revised Policy.
